Terms of service

The agreement between DreamX and the people who use it.

  1. 01These terms

    They apply when you use dreamxprod.com, the client portal, the talent workspace or the command centre. Using any of them means you accept them.

    Where you have signed a separate agreement, proposal or statement of work with DreamX, that document governs the engagement and these terms fill the gaps.

  2. 02What we provide

    Creative and production services — direction, identity, photography, film and event coverage — and the campaign and business systems around them, as described on this site and scoped in writing for each engagement.

    The workspaces are provided as they are. We work to keep them available, but we do not promise uninterrupted service, and we may change features as the studio's practice changes.

  3. 03Your account

    Keep your sign-in to yourself; you are responsible for what is done through it. Tell us promptly if you think someone else has access.

    Accounts are granted by us and belong to a named person. Do not share one, and tell us when somebody leaves your organisation so we can close theirs.

    We may suspend an account that is being used to break these terms or the law.

  4. 04Your material

    Anything you upload stays yours. You give us the permission we need to host it, process it and use it to deliver the engagement.

    You confirm that you have the right to give us what you give us — including, where people appear in it, the releases that allow it to be used as planned.

  5. 05The work we deliver

    Rights in finished work transfer on the terms of your engagement, and ordinarily once it has been paid for in full.

    Unless we have agreed otherwise in writing, DreamX keeps the right to show finished work in its own portfolio and marketing. If a project is confidential, say so before it starts and we will record that.

    The tools, systems and working methods behind the work remain ours.

  6. 06Fees and payment

    Project fees are set in the quote or statement of work for that engagement. Retainers bill on the interval shown when you start one and renew until cancelled.

    Payments are handled by Stripe. Invoices fall due on the date stated, and we may pause work on an overdue account.

    Studio hours included in a retainer are counted against that period and do not carry into the next unless we have agreed that in writing.

  7. 07Approvals and delivery

    A review is approved when it is approved in the portal, by someone entitled to approve it. Work that follows an approval proceeds on that basis, and revisiting it afterwards may be chargeable.

    Delivery links expire. Download what you are sent, and ask us for a fresh link if one has lapsed.

  8. 08Crew and assignments

    An assignment offered in the talent workspace is an invitation with a stated response deadline. It lapses if it is not answered by then.

    Accepting one is a commitment to be where it says, when it says. Tell us as early as you can if that changes.

    Rates, availability and performance records are held for staffing purposes and are not published.

  9. 09Acceptable use

    Do not use the service unlawfully, upload material you have no right to, attempt to reach another account's data, interfere with the service, or try to extract it wholesale by automated means.

  10. 10Liability

    Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

    Otherwise, neither party is liable for indirect or consequential loss, or for lost profit, revenue or data. Our total liability for an engagement is limited to the fees paid for it in the twelve months before the claim.

  11. 11Ending it

    Either of us may end an engagement on the notice set out in its own agreement. A retainer may be cancelled with effect from the end of the paid period.

    On ending, you pay for work done up to that point, and we give you the finished work that has been paid for.

  12. 12Governing law and changes

    These terms are governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction over disputes arising from them.

    We may update these terms; the date at the top shows when we last did. Continuing to use the service after a change means accepting it. Questions: dreamxproduction@gmail.com.
